Their daughter, Rachel, was born with cerebral palsy, a neurological condition that can greatly hamper mobility. Planning for Rachel\u2019s financial future, one without the everyday care of a parent, has always been top of mind.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjn86z000e3b6k2km0zt5v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Tung, 75, and Rachel, 36, live in the downstairs unit of a house walking distance from San Francisco\u2019s Golden Gate Park. Tung\u2019s son and his family live in a separate unit upstairs. When the family\u2019s will is activated, Rachel will inherit her share of this house through what is known as a special needs trust, which the Tungs set in place in 1997.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mj5ma600003b6kxlki2ro8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Inheriting the house outright, without such a trust, could cause Rachel to lose the public benefits on which she depends. Because of her disability, Rachel doesn\u2019t work.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjoio6000k3b6kooz1minb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cHousing is a really big concern, because when we\u2019re gone, who\u2019s going to take on this job?\u201d Tung said. \u201cIt\u2019s a whole big picture, and it\u2019s all on the parents.\u201d    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/related-content\/instances\/cm0mln8pj00053b6krgsuwzz9@published\" data-component-name=\"related-content\" class=\"related-content_full-width related-content_full-width--article\" data-article-gutter=\"true\">\n<div class=\"related-content_full-width__image image__related-content\">            <\/div>\n<p class=\"related-content_full-width__headline\">            <span class=\"related-content_full-width__title-text\" data-editable=\"content.title\">Related article<\/span>      <span class=\"related-content_full-width__headline-text\" data-editable=\"content.headline\">Be wary of offering \u2018help,\u2019 and other ways to support families with disabilities<\/span>    <\/p>\n<\/p>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjoio6000l3b6kzw1whldm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Like Tung, many parents taking care of adult disabled children are well past retirement age and experiencing their own mobility challenges. By 2050, the number of Americans over the age of 65 will increase by nearly 50%, according to&nbsp;projections by the Population Reference Bureau.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjoio6000m3b6kkcmo6l4s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            At the same time, people with disabilities also are living longer and aging at home instead of in institutions, according to experts like David Goldfarb, policy director at The Arc, a national disability advocacy organization.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjo4qg000i3b6kbg8bv6eb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cIf you go back 50 years, no one expected many people with disabilities to live very long,\u201d Goldfarb said. \u201cAnd now, the good news is, they\u2019re living much longer, thanks to advances in health care and public health. But the supports and services are not there to meet them.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpbj7000r3b6k8ksnoqxz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The situation can create a crisis for families as they scramble to find in-home or long-term care for two or three disabled family members. Many are turning to advocates and attorneys to better prepare for this longevity.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpbj7000s3b6kyxuo700s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cThey\u2019re looking to find a way to fill the gaps when they\u2019re gone, because nobody can do it like mom and dad,\u201d said Mercy Hall, a San Francisco attorney with the Hall Law Firm, which specializes in disability planning.    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/related-content\/instances\/cm0mlo5qv00083b6kmd99pmf2@published\" data-component-name=\"related-content\" class=\"related-content_full-width related-content_full-width--article\" data-article-gutter=\"true\">\n<div class=\"related-content_full-width__image image__related-content\">            <\/div>\n<p class=\"related-content_full-width__headline\">            <span class=\"related-content_full-width__title-text\" data-editable=\"content.title\">Related article<\/span>      <span class=\"related-content_full-width__headline-text\" data-editable=\"content.headline\">How to teach kids to befriend a child with a disability<\/span>    <\/p>\n<\/p>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpbj7000t3b6kow152q7j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            An increasingly popular option is a special needs trust, or SNT.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm10st4jk00003b6ky0zijjyr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Under&nbsp;Supplemental Security Income&nbsp;and many&nbsp;state Medicaid thresholds, individuals with disabilities enrolled in these programs can\u2019t hold more than $2,000 in their bank accounts, a limit that has not changed&nbsp;since the 1980s. They also can\u2019t own resources worth more than this limit, with several exceptions, including a single residence and vehicle. Generally, things such as an additional wheelchair-accessible van or an investment portfolio can\u2019t be held in the name of the person with a disability reliant on these benefits.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpbj7000v3b6kpz1fnjr2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            An SNT gets around the resource limits by handing over assets to a trustee, who is legally bound to use the funds strictly for the benefit of the person with a disability, known as the \u201cbeneficiary.\u201d Trustees make decisions guided by a letter of intent, written when a trust is established.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpbj7000w3b6ktuzq0m0j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Lawyers say the demand for such trusts is increasing.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjp8tg000p3b6k4c6n2ngg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cI think these trusts are becoming more and more necessary because the system is so unstable,\u201d said attorney Stephen Dale with The Dale Law Firm in Pacheco, California, which specializes in estate planning for families with disabilities. There are various kinds of trusts, which can provide not only a safety net but also guidance to navigate the confusing system of government-supported care.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00113b6k6deztne9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            To navigate this system, parents often become experts in the bureaucracy of social services.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00123b6ksgu0d9bu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            After a career as a graphic artist, Tung parlayed the expertise she learned from caring for Rachel into an administrative job with the organization Support for Families of Children with Disabilities. That isn\u2019t unusual; many professionals in the disability community are parents of disabled children.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00133b6k4sl4nmt8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cA lot of us are drawn to that work because we want to help other parents,\u201d Tung said.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00143b6kh1ru7r8r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Amy Tessler followed the same path. After 30 years as an industrial engineer, she became the education and outreach coordinator for The Dale Law Firm \u2014 the same firm that had created an SNT for her son, Scott, who is 28 and on the autism spectrum.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00153b6kmlc8mnmq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Tessler, 66, took the job to deepen her involvement in the disability community. In the meantime, she has learned the ins and outs of the SNT she and her husband set up for Scott when he was 9 years old.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00163b6k91aebrpi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            More important than the document, she said, are the people parents select to carry it out.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpytq00173b6khn1r6qwj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cJust because you have a document doesn\u2019t mean you have a plan for how your child is going to be cared for in the future,\u201d she said. \u201cPicking the right team to administer the special needs trust is what\u2019s critical.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjpw6m000z3b6k5i2dsnfq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Tessler selected a fiduciary \u2014 the professional trustee tasked with managing finances for a beneficiary \u2014 with an in-house care management team to take over both financial management and care services once she and her husband are no longer able to provide support themselves.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001c3b6k5i4qz6p7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cThere\u2019s lots of professional fiduciaries out there,\u201d Tessler said. \u201cBut I could only find one that was actually able to meet my needs.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001d3b6k4c3jrx3o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Tessler\u2019s fiduciaries \u2014 Jewish Family and Children\u2019s Services \u2014 already meet with Scott at least twice a year.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001e3b6kayicpnld@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cThey were ready to have a relationship with my son and myself, and the rest of my family now,\u201d Tessler said.    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/related-content\/instances\/cm0mli0y600033b6kas5lkfdp@published\" data-component-name=\"related-content\" class=\"related-content_full-width related-content_full-width--article\" data-article-gutter=\"true\">\n<div class=\"related-content_full-width__image image__related-content\">            <\/div>\n<p class=\"related-content_full-width__headline\">            <span class=\"related-content_full-width__title-text\" data-editable=\"content.title\">Related article<\/span>      <span class=\"related-content_full-width__headline-text\" data-editable=\"content.headline\">For adults, autism diagnosis can unlock a new life<\/span>    <\/p>\n<\/p>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001f3b6k44s3r9tl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Scott lives at Sunflower Hill, a residential community for adults with disabilities in California\u2019s East Bay.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001g3b6kmm2nv7km@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            He keeps a full schedule, Tessler said, including an adult day program and a host of activities, some of which are facilitated by Sunflower Hill. Scott participates in the Special Olympics, tennis, yoga, walking club, karaoke nights, cooking classes and weekly potluck dinners.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001h3b6ktqf6ua8w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            He lucked into the apartment a few years ago when a friend of his was selected in a lottery. Scott moved in as a roommate.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001i3b6kg6g19tf6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Right now, he goes home to Oakland on the weekends but plans to live eventually at Sunflower Hill full time.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqinu001j3b6k198flsu1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Because of his parents, Sunflower Hill and public benefits, Scott has a strong support system. The SNT is in place to pay for unmet needs and enhance his quality of life after his parents die. It also could help Scott through transitions, like changes in public benefits or housing.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjqggd001a3b6knilwulie@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cWe don\u2019t have a guarantee that what he has now is going to continue for the rest of his life,\u201d Tessler said.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjr5j5001o3b6kdu5axftb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            She updates the trust\u2019s planning documents every six months to reflect changes in her son\u2019s life.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjr5j5001p3b6kao7vye90@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cIn a lot of ways, the trust is an alter ego for the parent,\u201d Dale said. \u201cA properly done trust is going to focus on more than just the public benefits.\u201d    <\/p>\n<h3 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm0mjrawa001r3b6kli4vlpdq@published\" data-component-name=\"subheader\" id=\"avoiding-pitfalls\" data-article-gutter=\"true\">        Avoiding pitfalls<\/p>\n<\/h3>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjr3i6001m3b6kav1y3i4c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Choosing the right trustee is important.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjtacw001w3b6kwrwd1flf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cYou\u2019re giving up your money,\u201d said Goldfarb, policy expert at The Arc. However, making a sibling the gatekeeper of the money can create an uncomfortable dynamic, said Hall, the San Francisco attorney. And a trusted family friend might not have the skills for it.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjt6yd001u3b6kwxs47oxi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cIt\u2019s better to let the siblings continue to be siblings, and not take on the role of gatekeeper to the money,\u201d Hall said. \u201cYou might have somebody who has the biggest heart in the world, and they may not be that good with finances.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjtp5500233b6k6s0sooa2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Families frequently go to court because of disagreements over an SNT.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjtp5500243b6kxtjrxmtx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            To avoid that, Dale encourages his clients to designate a family member as trust protector instead of trustee. A trust protector has the power to remove and replace a trustee if necessary.    <\/p>\n<h3 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm0mjtt1500263b6kyuif8049@published\" data-component-name=\"subheader\" id=\"managing-your-money-manager\" data-article-gutter=\"true\">        Managing your money manager<\/p>\n<\/h3>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjtn1600213b6ktuqo7jg0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Sabrina Padillo is a social worker and case coordinator for the care management company Rehabilitation Care Coordination in San Diego. She works on the other end of SNTs \u2014 overseeing the care of an individual as instructed in a trust document.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjz16n002b3b6kglpk39rx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Padillo sees some clients weekly, others yearly, to coordinate medical care and government benefits. Sometimes she helps clients through life transitions. For example, she\u2019s helped clients move to Thailand, and another to evict squatters from their house.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjywab00293b6k7qoxrpof@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cTheir job is to manage the finances,\u201d Padillo said of fiduciaries. \u201cOur job is to manage the person.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjzk5v002g3b6ktrlfkucn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Without the right expertise, fiduciaries have sometimes based decisions more on finances than needs, she said, such as purchasing a two story-house for someone who has trouble with stairs, or an SUV in place of a wheelchair-accessible van.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjzk5v002h3b6kdf0k3w2c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Families, she said, sometimes misunderstand the limitations of an SNT.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjzk5v002i3b6kut5c4lhk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cWe\u2019re not taking the whole entire family to Disneyland,\u201d Padillo said.    <\/p>\n<h3 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm0mjzzkc002k3b6kfakuq4a2@published\" data-component-name=\"subheader\" id=\"what-kind-of-trust-should-i-choose\" data-article-gutter=\"true\">        What kind of trust should I choose?<\/p>\n<\/h3>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mjz53m002e3b6ktbuhbwqw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The Tungs and Tesslers set up third-party SNTs for Rachel and Scott. Third-party trusts are often established well ahead of when they are needed and are funded once or multiple times by someone other than the person with the disability, such as their parents, extended family or friends.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk0u49002p3b6kn2wkwq9o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The decision to set up a trust often happens at around age 18, when many individuals with disabilities are eligible for Supplemental Security Income and Medicaid for the first time. This marks the beginning of what is known as the transition years in which families begin to exit the school system.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk0r3u002n3b6k1d30ipul@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Third-party trusts can take weeks to months to set up, depending on a range of circumstances.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh6002u3b6kht94y33m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            But SNTs also can be set up in a pinch, as first-party trusts, often to hold money from lawsuit settlements in medical malpractice cases.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh6002v3b6k43y9eu5y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            A first-party trust can be funded directly by the person with the disability themselves, but comes with more restrictions, and is generally subject to Medicaid payback after the beneficiary dies. This means the state can claim whatever is left in the first-party trust up to the amount Medicaid paid on the behalf of the person with the disability.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh7002w3b6k7fe4uy42@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cI\u2019ve had clients who are in their 80s, and their child dies, and they have nothing. Literally nothing,\u201d Hall said.    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/related-content\/instances\/cm0mpsic500013b6k68owsrfr@published\" data-component-name=\"related-content\" class=\"related-content_full-width related-content_full-width--article\" data-article-gutter=\"true\">\n<div class=\"related-content_full-width__image image__related-content\">            <\/div>\n<p class=\"related-content_full-width__headline\">            <span class=\"related-content_full-width__title-text\" data-editable=\"content.title\">Related article<\/span>      <span class=\"related-content_full-width__headline-text\" data-editable=\"content.headline\">Parents are not OK right now. Here\u2019s what they can do<\/span>    <\/p>\n<\/p>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh7002x3b6kep78jhqa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The Urbatsch Law Firm in Berkeley, which focuses on special needs estate planning, charges a flat fee that can range from $5,000 to $8,000 to set up a trust. Lawyers with expertise in SNTs caution against setting up lower-cost trusts with nonspecialized lawyers who might not tailor trust documents to individual cases or be able to connect families to other resources in the disability community.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh7002y3b6k7ksvi94w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            For families with a smaller amount of money to save, typically under $60,000, pooled trusts might be an appealing option. These SNTs have lower startup costs and are managed by nonprofit organizations. They can be either first- or third-party trusts.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1oh7002z3b6kdo27f0rr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The Golden State Pooled Trust, operated by The Dale Law Firm, has an upstart cost of around $1,500.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk1lzh002s3b6k832eygso@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cI personally think the future is pooled trusts,\u201d said Dale, who is also the president of the Alliance of Pooled Trusts \u2014 an organization that establishes best practices in the industry.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk26g700343b6k31g86i46@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Dale emphasized that these trusts are not just for individuals with less money to hold, but for anyone who would like to tap into the team of resources built by the pooled trust nonprofit.    <\/p>\n<h3 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm0mk2wbm00363b6keo66a4v6@published\" data-component-name=\"subheader\" id=\"able-accounts-and-snts\" data-article-gutter=\"true\">        ABLE accounts and SNTs<\/p>\n<\/h3>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk22a100323b6kd1xyt4ml@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Achieving a Better Life Experience, or ABLE, accounts are another tool that can work with SNTs to maximize financial independence.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3r0f003b3b6k6380yhwf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Passed in 2014, the ABLE Act allowed states to create programs where individuals with disabilities can start their own bank accounts to save and spend more freely. Unlike SNTs, ABLE accounts can be owned and accessed directly by the person with the disability.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3r0f003c3b6ksb0djdzc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            They can hold up to $100,000 without impacting the public benefits. This year, the annual contribution limit is $18,000.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3r0f003d3b6kv1oiro9w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cA lot of what we\u2019re trying to do is educate individuals on finances in general,\u201d said Alisa Ferguson, program manager of Virginia\u2019s ABLEnow. \u201cThese are individuals who haven\u2019t been able to save.\u201d    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/related-content\/instances\/cm0mq36ko000g3b6k7ztpgnl8@published\" data-component-name=\"related-content\" class=\"related-content_full-width related-content_full-width--video\" data-article-gutter=\"true\">\n<div class=\"related-content_full-width__image image__related-content\">\n<div class=\"image__label image__label--type-video image__label--small image__label--visible\">            <span class=\"image__label-icon\"><\/span>video          <\/div>\n<\/p>\n<\/div>\n<p class=\"related-content_full-width__headline\">            <span class=\"related-content_full-width__title-text\" data-editable=\"content.title\">Related video<\/span>      <span class=\"related-content_full-width__headline-text\" data-editable=\"content.headline\">An aunt she didn\u2019t know existed: Discovering the truth about institutionalized disabled children in America<\/span>    <\/p>\n<\/p>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3r0f003e3b6kv432ffxf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Without ABLE, benefit recipients often spend to keep their accounts below the $2,000 limit.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3r0f003f3b6k60txsk2f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cSpending it down is what they call it,\u201d Ferguson said. \u201cSpending it on anything they can get their hands on \u2014 shoes, TVs, things you don\u2019t necessarily need.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk3nxt00393b6kfjvn0nz5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            ABLE Accounts are more liquid than SNTs. Virginia\u2019s program includes a debit card, which allows for spending on everyday items like restaurants, trips to the pharmacy and clothes. Some programs also allow for the money to be invested.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk4jow003k3b6kgh3bj66v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            SNTs can be set up to fund ABLE accounts.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk4jow003l3b6k917eaml7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            However, like first-party SNTs, ABLE accounts may be subject to Medicaid payback after the individual with a disability dies.    <\/p>\n<h3 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm0mk4nly003n3b6k0qgar0g1@published\" data-component-name=\"subheader\" id=\"rachels-future\" data-article-gutter=\"true\">        Rachel\u2019s future<\/p>\n<\/h3>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk4gwc003i3b6kp9urzmsm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Linda Tung handles Rachel\u2019s finances. But when she is gone, that responsibility will fall to her son, who will be the trustee of Rachel\u2019s SNT.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6bky003s3b6ke5vmsols@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            When her husband died in 2010, Tung took on more responsibility than she had anticipated caring for their daughter. The same month, Rachel aged out of the school system and started a new route at The Arc of San Francisco.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6bky003t3b6k97ib1pwm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Two of Tung\u2019s concerns for Rachel\u2019s future are housing and care. Last year, she placed Rachel on two waitlists for supportive housing, but she believes it might take another five years for her to be offered a spot.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk5yww003q3b6k7b4oj08d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Mother and daughter are keen to start the transition sooner rather than later. Rachel is social, strong-willed and relishes her independence.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6tcz003y3b6ki7qcuvtr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cI\u2019m missing camp,\u201d she said, shortly after coming home from the Santa Cruz Mountains summer camp that she has attended for more than 10 years. \u201cI cried last night.\u201d    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6tcz003z3b6knehf42kv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Rachel and her mother share a love for San Francisco, its arts and its culture. \u201cShe\u2019s definitely a city girl,\u201d Tung said. Rachel agreed.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6tcz00403b6knkiweihp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            Artwork by mother, daughter and friends hang around the house. Tung frequents the Legion of Honor and de Young museums. Rachel prefers the Academy of Sciences but participates twice a week at an art program run by The Arc. Rachel met her new boyfriend at The Arc.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6tcz00413b6kwzzh33e8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            In her living room, Rachel draws smiley faces with markers. At the studio, she is working on a large acrylic painting. \u201cShe\u2019s prolific,\u201d Tung said. A few years ago, Rachel sold a painting in an exhibit on Castro Street.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0mk6tcz00423b6kv5jvkk0s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            The SNT is a piece of the plan Linda Tung is putting in place for Rachel to allow her the freedom to continue doing what she enjoys.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm0o8xyw800003b6kp1aops5l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">            \u201cYou don\u2019t want your kid to be 40 years old and you to be 80 and you die, and for the first time they don\u2019t have you there.
